Drug Possession and Drug Trafficking
Mandatory minimum sentences have been declared unconstitutional in most counties in Pennsylvania including Bucks, Montgomery and Philadelphia Counties. However, judges are still mindful of the quantity of drugs involved and prior drug convictions in sentencing which factors can aggravate a sentence. Drug defenses often include the suppression of evidence illegally seized as a result of an unlawful stop, search or interrogation. The strength of a pre-trial motion to suppress evidence is a formidable tool in defense strategy in drug cases. Moreover, establishing that possession is for personal use rather than for delivery reduces the charge from a felony to a misdemeanor.
Alternate dispositions are available in drug cases including ARD and Section 17, both of which avoid the usual license suspension for a drug conviction. Most counties in southeast Pennsylvania including Bucks, Montgomery, Philadelphia, Delaware and Chester have Drug Courts, House Arrest Programs, credit for time spent in inpatient treatment and Work Release.
